从裁执分离谈我国行政强制执行制度

摘　　要：行政强制执行权力的配置直接关系到了行政强制执行的效率,是行政强制执行行为从决定到落地的关键一跃,对于行政相对人的合法权益保护具有重大意义。裁执分离观念是塑造我国行政强制执行制度构成的关键因素,同时也影响了我国行政强制执行制度的未来发展轨迹。根据裁执分离理念,当行政机关有采取行政强制执行措施需要时要将行政强制执行行为的最终决定权交由法院,由法院来作出是否准许进行行政强制执行的决定。而后行政机关才能根据法院授权来负责落实行政强制执行行为。通过完善、细化行政强制执行的相关法律,通过探索构建专门的行政法院,在我国构建起以司法权为主导的行政强制执行模式。进而加强对行政权力运行的监督和制约机制建设,解决现行行政强制执行制度所造成的一系列问题。The allocation of administrative enforcement power has direct relation with the efficiency of administrative enforcement,and it is the key leap of administrative enforcement behavior from decision to implementation,which is of great significance to protect the legitimate rights and interests of the administrative counterparts.The concept of separation is the key factor to shape the composition of administrative enforcement system.At the same time,the future development trajectory of China’s administrative enforcement system is also affected.In accordance with the concept of separation of adjudication,When an administrative organ needs to take the administrative compulsory execution measures,the final decision of the administrative compulsory execution act shall be entrusted to the court,and the court shall make the decision of whether to allow the administrative compulsory execution.After that,the administrative organ can be responsible for the implementation of administrative enforcement acts with regards to the authorization of the court.By the exploration of the construction of special administrative courts,the administrative enforcement mode dominated by judicial power is constructed in China.Therefore,there is a need to strengthen the supervision and restriction mechanism construction of the operation of administrative power,and to solve a series of problems caused by the current administrative enforcement system.
