不作为故意杀人罪量刑实证研究--以遗弃致死为切入点

摘　　要：不作为故意杀人罪实践中量刑偏差严重,同案异判情况突出。然而相关理论研究匮乏、量刑问题缺少关注。以2001年至2020年相关不作为故意杀人罪案件为样本,多元线性回归分析发现影响不作为故意杀人罪有期徒刑刑期的因素为自首、认罪认罚、从犯。二元logistic回归分析发现影响不作为故意杀人罪缓刑适用的因素为认罪认罚。由此确定不作为故意杀人罪有期徒刑刑期及缓刑的基准刑,规范不作为故意杀人罪量刑细则,扭转量刑失衡怪相。in the practice of omission intentional homicide,the sentencing deviation is serious,and the situation of different judgments in the same case is prominent.However,there is a lack of relevant theoretical research and sentencing issues.Taking the relevant cases of omission intentional homicide from 2001 to 2020 as samples,multiple linear regression analysis shows that the factors influencing the term of fixed-term imprisonment of omission in-tentional homicide are voluntary surrender,confession and punishment,accomplice.Binary logistic regression analysis found that the factor influencing the application of probation of omission intentional homicide was con-fession and punishment.Therefore,it is suggested to determine the benchmark sentence of fixed-term imprisonment for the crime of omission intentional homicide,make clear that the circumstances of the crime are lighter,and judge from the perspective of criminal motivation and behavior mode,which is conducive to judicial justice.
