摘　　要：社会主义核心价值观是我国法治建设的灵魂,需明确其法源地位。总体而言,社会主义核心价值观应当定位为超越部门法的一般法律原则。在法律规范体系内,已经入宪、不断入法的立法实践表明社会主义核心价值观已成为诸多法律共同认可的基本原则;在司法实践中,无论是疑难案件还是普通案件的处理,社会主义核心价值观发挥作用的方式都与法律原则高度一致。这些方面都明确了社会主义核心价值观的正式法源地位。结合当前立法和司法实践,可通过以下基本路径提升社会主义核心价值观的法源作用:正式法律制度应当继续直接吸收社会主义核心价值观,特别需要重视案例指导制度;多种法律适用方法(尤其是法律解释方法)能够在司法过程中推动社会主义核心价值观与案件释法说理的有机结合;司法者也应积极理解和适用社会主义核心价值观,并有效回应其他诉讼参与者的相关意见。Core socialist values are the main guide for rule of law in China,of which we should make sure about the role in the legal source system.Generally speaking,core socialist values are general legal principles beyond the department law.In the legal norm system,core socialist values are written in the constitution and some other laws,which shows the role of basic principles in every aspect of law;in judicial practice,the way in which core socialist values play a role is highly consistent with legal principles,no matter in the handling of difficult cases or ordinary cases.So core socialist values are formal legal sources.To improve the effect of core socialist values,some measures are important:formal legal institutions should continue to absorb them,especially the guiding case system;many methods of legal application,especially legal interpretation,can promote the combination of core socialist values and case interpretation and reasoning in the judicial process;judges should be active in the application of core socialist values based on right understanding,and effectively respond to others’opinions in judicial practice.
