交通事故案件中肇事逃逸行为的界定方法探析

摘　　要：目前全国各地交警部门对于交通事故肇事逃逸的界定看法不一,界定的方式包含事故民警对交通事故肇事逃逸的个人理解和主观判断,没有客观统一的标准。本文针对此问题,通过查阅相关法律文献并结合工作实际,总结界定交通事故肇事逃逸需要的四个条件,为事故民警在工作中客观判断交通事故肇事逃逸行为提供参考。At present,traffic police departments across China have different views on the definition of hit-and-run traffic accidents.The definition method includes the personal understanding and subjective judgment of accident police officer on hit-and-run traffic accidents,and there is no objective and unified standard.In view of this problem,this paper summarizes and defines the four conditions required for the hit-and-run traffic accident by consulting relevant legal documents and combining with the actual work,so as to provide reference for the accident police officer to objectively judge the hit-and-run behavior in traffic accidents.
