摘　　要：国际贸易协定中的国有企业规则包括了国有企业、非歧视待遇、商业考虑、透明度、非商业援助及争端解决机制等内容。从近些年的发展情况看,西方发达国家基本达成共识,且呈现日益转变成国际经贸规则主流、条款内容和标准都有很大变化、完全背离竞争中立原则初衷等特点,对中国国有企业公平参与国际竞争产生了较大的制约。应旗帜鲜明地表明中国有关国有企业规则的主张,深入推进中国国有企业改革,积极参与全球经贸规则重构博弈,更好地保障中国国有企业合法权益,使中国国有企业能够公平参与国际竞争。The state-owned enterprise rules in international trade agreements include state-owned enterprises,non-discriminatory treatment,commercial considerations,transparency,non-commercial assistance and dispute settlement mechanisms.From the development in recent years,the western developed countries have basically reached a consensus,and show the characteristics of increasingly transforming into the main subjects of international economic and trade rules,great changes in terms and standards,and completely deviating from the original intention of the principle of competitive neutrality,which has greatly restricted the fair participation of Chinese state-owned enterprises in international competition.We should clearly state China’s position on the rules of state-owned enterprises,further promote the reform of China’s state-owned enterprises,actively participate in the game of restructuring global economic and trade rules,better protect the legitimate rights and interests of China’s state-owned enterprises,and enable China’s state-owned enterprises to participate in international competition fairly.
