生态环境公益损害赔偿资金统筹监管研究

摘　　要：生态环境公益损害赔偿资金是指环境公益导向下的生态环境损害赔偿资金与环境公益诉讼赔偿资金统称。当前,生态环境公益损害赔偿资金监管分散而混乱。应当以统筹监管路径破解现有困局,将生态环境修复费用、服务功能损失费用以及惩罚性赔偿费用纳入统筹监管范围,并根据不同阶段的资金属性,构建分阶段统筹监管路径:适用阶段应当区分索赔情形、明确索赔重心以及避免索赔重复,实现索赔互补;管理阶段应按照从分散到集中、从分类到整合的方式进行合并管理;使用阶段应由赔偿权利人指定的部门、机构统筹安排和使用资金,并根据各项费用的不同特性分别考虑使用方式。Eco-environmental public welfare damage compensation funds refer to the collective name of ecological environmental damage compensation funds and environmental public interest litigation compensation funds guided by environmental public welfare.At present,the supervision of compensation funds for ecological environmental public welfare damages is scattered and chaotic.The existing dilemma should be solved by an overall supervision path.The ecological environment restoration costs,service function loss costs and punitive compensation costs should be included in the overall supervision scope,and the phased overall supervision path should be constructed according to the financial attributes of different stages.To be specific,in the application phase,we should distinguish the claim situation,clarify the focus of the claim,avoid duplication of claims,and realize the complementarity of claims.In the management phase,we should consolidate and manage the funds in a way from decentralization to concentration and from classification to integration.And in the use phase,the department and organization designated by the compensation right holder should coordinate the arrangements and use of the funds,and consider the use methods according to the different characteristics of the costs.
