《美墨加协定》汽车原产地规则特征及启示

摘　　要：《美墨加协定》原产地规则特别是有关汽车的原产地规则设置,具有一定的代表性和参考价值。深入分析《美墨加协定》汽车原产地规则概况及与《北美自由贸易协定》的异同,着重剖析《美墨加协定》汽车原产地规则有关劳动价值含量条款及其高工资组成成分条款的设计方法和特征,并从原产地规则灵活性、文本更新扩充、敏感产业的相关规则制定、配套文件出台和企业参与等角度提出我国相关制度改革的建议。The rules of origin of the automotive industry in the USMCA have great values for reference. This paper deeply analyzes the differences and similarities of the rules of origin of the automotive industry between the USMCA and the NAFTA, focuses on the design methods and characteristics of the labor value content provisions as well as the high-wage components provisions related, and raises up suggestions of reforming the rules of origin in China from the aspects of the flexibility of the rules, the renewal and expansion of texts, the protection of sensitive industries, supporting documents as well as participation of firms related.
