摘 要:在监察体制改革之后,全国检察机关自侦部门转隶,业务范围转向公益诉讼,于是环境公益诉讼成为当前环境保护的主要手段。环境公益诉讼的前提之一是界定生态环境损失的总价值,这是判断赔偿数额的标准,而要界定生态环境损失的总价值就必须要进行生态损害价值鉴定。实践中,由于生态环境损失价值鉴定较为专业、投入成本较高,因而鉴定收费特别高,被认为是“天价”,阻碍了生态损害赔偿案件的正常进行和生态环境的修复。因此,利用金融工具通过保险制度,合理规定模式设定、承保范围、理赔项目、理赔资金来源、免责条款等具体内容,就可以化解环境公益诉讼中的“天价”鉴定费的问题,使公益诉讼中的鉴定程序得以完成,生态环境得以有效修复。After the reform of the supervision system,the scope of service of procuratorial organs includes the public interest litigation,hence environmental public litigation has become the main method of protecting environment.One of the premise of environmental public interest litigation is to define the whole value of ecological environment loss,which is the standard for judging the amount of compensation.Before defining the whole value of ecological environment loss,the value of ecological damage have to be authenticated.In practice,since the value of ecological damage is professional and costly,appraisal cost is regarded"outrageous prices".Due to the"outrageous prices",the cases of compensation litigation for environment damages can not process normally.In the meantime,the"outrageous prices"impede the environment recovery.Therefor,by using an insurance system to resolve the problem of extremely high appraisal cost is good way.This method could help carry out the identification procedures of public interest litigation,and ecological environment could be restore.
