论平台经济反垄断规制中相关市场之界定

摘　　要：平台经济的迅速发展既为市场注入了活力也带来了不利于竞争与创新的要素。近年来国家愈发强调平台经济领域反垄断规制的重要性,平台经济也迎来了前所未有的强监管环境。相较于传统经济,平台经济在市场结构、定价模式、竞争核心要素等方面均存在较大不同,也给相关市场界定造成了基准产品难界定、相关市场数量难确定、价格分析失灵的困难。未来,需要坚持将相关市场界定作为平台经济反垄断规制的前置程序,强调需求替代的核心地位,重视基准产品的确认,并合理认识SSNIP测试的局限性。The rapid development of the platform economy has not only injected vitality into the market,but also brought elements that are not conducive to competition and innovation.In recent years,the country has increasingly emphasized the importance of anti-monopoly regulations in the platform economy,and the platform economy has also ushered in an unprecedented strong regulatory environment.Compared with the traditional economy,the platform economy is quite different in terms of market structure,pricing model,and core elements of competition.It also creates difficulties in defining the relevant market for benchmark pro-ducts,determining the number of relevant markets,and analysising prices.In the future,it is necessary to adhere to the definition of the relevant market as a pre-procedure for anti-monopoly regulation of the platform economy,to emphasize the core position of demand substitution,to attach importance to the confirmation of benchmark products and to understand the limitations of SSNIP testing reasonably.
