摘 要:新文科建设的提出是基于新时代的要求和大学文科教育内在发展逻辑之双重需要,重点任务在于以问题为导向改造传统的文科人才培养模式。新文科建设要求法理学课程的知识传授立足中国,回应现实。对照这些需求,我国当前法理学课程的设置模式不利于理论与实践的融合,法理学教材没有彰显中国特色,教学方式不能培养学生的主动性。造成这些现象的深层原因在于我国目前法理学本科教育定位不合理。为此,法理学课程体系的优化应结合新文科建设的要求,将法理学本科教育定位为立足中国现实、传授法律知识、培养法律思维、塑造法律品格。在遵循这一定位的基础上,将疑难案例分析作为法理学课程体系改革的切入点,以此确立并深化二阶段课程设置模式、更新法理学教材内容、丰富法理学教学形式。The construction of the New Liberal Arts is based on the requirements of the new era and the dual needs of the internal development logic of university liberal arts education.The key task is to reform the traditional liberal arts talent cultivation model based on the problem.The construction of the New Liberal Arts requires the knowledge transfer of jurisprudence courses to be based in China and respond to reality.According to these needs,the current setting model of jurisprudence courses in China is not conducive to the integration of theory and practice,jurisprudence textbooks do not show Chinese characteristics,teaching methods cannot cultivate students'initiative.The underlying reasons for these phenomena lie in the unreasonable orientation of our country's current undergraduate education in jurisprudence.Therefore,the optimization of the jurisprudence curriculum system should be combined with the requirements of the construction of New Liberal Arts,and the orientation of undergraduate education of jurisprudence should be based on the reality of China,and educate students by offering the knowledge,forming the thinking pattern,and shaping the character.Based on this orientation,hard cases5analysis can be used as the entry point for the reform of the jurisprudence curriculum system to establish and deepen the two-stage curriculum model,update the content of jurisprudence textbooks,and enrich the teaching methods of jurisprudence.
