环境犯罪刑法适用问题探析——以野生动物资源保护刑法规制为视角

摘　　要：随着新时代的发展和生态文明建设进程中,野生动物资源在生态系统中具有不可忽视的重要作用,同时也越来越引起人们的重视。当下环境犯罪手段越来越复杂多样,亟待人们采取有效的措施来积极应对环境犯罪。本文通过野生动物资源的刑法规制为切入点,进而提出环境犯罪在刑法适用过程中面临的问题,然后有针对性的采取优化刑事立法理念,适当扩大环境犯罪保护范围以及优化环境犯罪刑罚结构,通过这三个措施来完善环境犯罪在刑法适用过程中面临的困境。希望这三个措施能为环境犯罪在刑法适用中带来肯定和积极的效果。With the development of the new era and the process of ecological civilization,wildlife resources have an important role in ecosystems,and it is increasingly attracting people's attention.The underlying environmental crime is more complex and diverse,and it is urgent to take effective measures to actively address environmental crimes.In this paper,the criminal law of wildlife resources is the entry point,thereby proposing environmental crimes in the process of application of criminal law,and then targeted to optimize criminal legislation concept,and to expand the scope of environmental crime protection and I hope that these three measures can bring affirmative and positive results to environmental crimes in the application of criminal law.
