欧盟数据跨境传输标准合同条款新发展及启示

摘　　要：[研究目的]随着大数据时代的到来,出台标准合同条款(SCCs)用以规范数据跨境传输活动或将成为各国的一种普遍做法。对欧盟数据跨境传输SCCs的新发展进行研究,有助于借鉴欧盟经验,进一步完善中国的相关立法。[研究方法]通过文本研究与案例研究相结合的方式,分析欧盟数据跨境传输SCCs的发展历程,论述其变化的新特点,阐明新版SCCs出台对欧盟乃至全球数字贸易规则发展的意义。[研究结论]相较于旧版,欧盟新版数据跨境传输SCCs具有更为丰富的应用场景、更为明确的权利义务,并且创造性地提出了对接条款。它的出台,不仅有助于促进欧盟相关规则的完善、欧洲单一数字市场的形成以及欧盟数字主权的维护,而且有利于推动相关领域统一规则的形成、企业合规性的提升以及全球数字贸易的长远发展。中国应当以欧盟SCCs为参考,尽快完善本国数据跨境传输规则体系,并积极参与相关领域的国际合作和统一规则构建。[Research purpose]With the advent of the era of big data,it may become a common practice for all countries to issue standard contract clauses(SCCs)to regulate cross-border data transmission activities.The research on the new development of SCCs for cross-border data transmission in the European Union(EU)is helpful to learn from the experience of EU and further improve the relevant legislation in China.[Research method]By combining text research and case study,this paper analyzes the development process of SCCs concerning cross-border data transmission in EU,discusses the new characteristics of its changes,and clarifies the significance of the new SCCs for the development of digital trade rules in the EU and even the world.[Research conclusion]Compared with the old version,the new one has more abundant application scenarios,clearer rights and obligations,and creatively proposes the docking clauses.Its introduction will not only help to improve the relevant rules of the EU,the formation of the European single digital market and the maintenance of the EU's digital sovereignty,but also help to promote the formation of unified rules in relevant fields,improve the compliance of enterprises and the long-term development of global digital trade.China should take the EU SCCs as reference,improve its own rules for cross-border data transmission as soon as possible,and actively participate in international cooperation and the construction of unified rules in relevant fields.
