摘 要:当前,侵害保险消费者权益乱象较多,主要表现在条款缺陷、故意误导、理赔拖欠、保费偏高、恶意退保、捆绑搭售、垄断经营、侵占个人信息、信息披露不足、投诉维权艰难、知识普及不够等方面。对此,笔者提出修订完善条款,消除自身缺陷;治理销售误导,规范销售行为;提升理赔时效,解决理赔问题;合理厘定保费,给消费者释负;打击扫除“两害”,净化经营环境;消除捆绑垄断,还投保选择权;保护个人信息,避免电话扰民;充分披露信息,让轨迹可回溯;尊重正当诉求,严惩恶意投诉;加强宣传教育,普及保险知识等措施,保护保险消费者权益,提升保险消费者对保障的获得感。At present,there is a lot of chaos infringing on the rights and interests of insurance consumers,mainly in terms of defects,intentional misleading,claim arrears,high premium,malicious surrender,bundling and tying,monopoly operation,occupation of personal information,insufficient information disclosure,difficult complaint rights protection,insufficient knowledge popularization and so on.The main measures to deal with these chaos:revise and improve the provisions and eliminate their own defects;Manage misleading sales and standardize sales behavior;Improve the timeliness of claim settlement and solve the problem of claim settlement;Reasonably determine the premium and release the burden to consumers;Crack down on and eliminate the "two evils" and purify the business environment;Eliminate binding monopoly and insurance option;Protect personal information and avoid telephone interference;Fully disclose the information and make the track traceable;Respect legitimate demands and severely punish malicious complaints;Strengthen publicity and education and popularize insurance knowledge.
