摘 要:公职人员的隐私权是基于普通公民的隐私权发展而来的。狭义的隐私权概念只是属于侵权责任法规定的一项具体人格权,而广义的隐私权则包括涉及个人私域的敏感信息。公职人员掌握大量的公共权力,处于特殊主体的地位,其隐私权相较于普通公民受到更多限制。本文探讨公职人员的隐私权在大数据治理模式下所遭遇的问题及面临的挑战,以数据正义理论平衡社会公共秩序的保护与个人隐私权保护之间的价值冲突,倡导人文主义的价值观念,从立法和制度层面探索公职人员隐私权的保护路径。The right to privacy of public officials is based on the development of the right to privacy of ordinary citizens.The concept of privacy right in a narrow sense is only a specific personality right stipulated in the Tort Liability Law,while the privacy right in a broad sense also includes sensitive information involving the private domain of individuals.Since public officials hold a large amount of public power,their right to privacy is subject to more restrictions than that of ordinary citizens based on their special subjects status.This article discusses the problems and challenges of the privacy of public officials under the big data corruption governance model,in hopes of balancing the value conflict between the protection of social public order and the protection of individual privacy with the theory of“data justice”,advocating the value of humanism,and explores the protection path of public officials right to privacy from the legislative and institutional levels.
