摘 要:监察机关的政务处分权能具有复合性,既在法定的权责内容上体现出准执法性,又因与党的政治生活高度关联而体现出涉政治性。因此,政务处分救济制度的构建应以其复合性为逻辑基点。外部救济机制存在现实的局限与障碍,并非构建政务处分救济制度的适宜选择。内部救济路径有其理论层面和实践层面的独特制度价值,在处分救济上更具合理性与可行性。现行的救济制度仍存在一定程度的不足,宜对其作适当的补充完善,增设复审、复核程序的再复核机制,听取被处分人意见机制,以及其他单位相关人员的参与机制,以期促进政务处分工作的政治效果、法律效果与社会效果实现有机融合。The power and function of supervisory organs to take governmental sanctions are composite in nature,reflecting not only quasi-administrative natture in terms of statutory stipulations on powers and responsibilities,but also highly related to the political activities of the CPC.Therefore,the establishment of the relief system should regard its composition as its logic base.Considering the realisic limitations and obstacles of the external relief mechanism,it is not a feasible option for the establishment of the governmental sanctions relief system.The internal relief approach has its own unique institutional value at the theoretical and practical layer,which is more reasonable and feasible for governmental sanctions relief.The current governmental sanctions relief system still has certain degree of deficiencies.It is appropriate to supplement and improve it by adding the mechanism of re-examination for review and review,the mechanism to listen to the opinions of the punished person,and the participation mechanism of relevant personnel of other organs,so as to promote the organic integration of political,disciplinary and social effects of governmental sanctions work.
