摘　　要：作为由国家监察委员会制定,针对监察领域相关事项进行规定并且在全国范围内具有普遍拘束力的法规范形式,监察法规是对以《监察法》为核心的监察法规范体系的丰富和发展,在“自上而下”的监察法典化路径以及“自下而上”的法规探索化路径中均发挥着重要作用。国家监察体制改革探索建构“不敢腐、不能腐、不想腐”的腐败治理制度体系,监察法规在其中发挥着重要作用。在“不敢腐”的立法导向下,监察法规以落实落细日常监督、整合社会监督力量以及完善监察问责制度等作为重要的功能面向;在“不能腐”的立法导向下,监察法规以健全监察信息公开制度、特约监察员制度、请托事项报告制度以及财产申报制度等作为重要的功能面向;在“不想腐”的立法导向下,监察法规以完善廉政教育制度、强化公职人员道德操守等作为重要的功能面向。As a form of legal norms formulated by the National Supervisory Commission,which regulates relevant matters related to the field of supervision and generally binding nationwide,supervision regulations are an enrichment and development of the supervision law system with the Supervision Law as its core,which play an important role in both the“top-down”path of supervision codification and the“bottom-up”path of regulation exploration.The reform of the national supervision system explores the construction of a corruption governance system that“dares not corrupt,cannot corrupt and does not want to corrupt”,in which supervision regulations play an important role.Under the legislative orientation of“not daring to corrupt”,the supervision laws and regulations take the implementation of detailed daily supervision,integration of social supervision forces and improvement of the supervision accountability system as important functions.Under the legislative guidance of“cannot corrupt”,the supervision laws and regulations are oriented to improve the system of supervision information disclosure,system of special inspectors,system of reporting entrusted matter and system of property declaration as important functional aspects.Under the legislative guidance of“does not want to corrupt”,the supervision laws and regulations are supposed to improve the integrity education system and strengthen the moral conduct of public officials as an important functional orientation.
