监察法治话语与中国话语逻辑——以留置的对等英译问题为例

摘　　要：《监察法》以留置取代“双规”是法治反腐的重大进步,是党和国家契合中国特色实践进行反腐的智慧结晶。但“留置”措施这一创新的法律概念并无对等的英译表达,在中西话语体系斗争中,中国特色监察法治需要阐释中国语境下的监察法治话语和话语逻辑,逐渐消解国际反腐合作中西方国家对中国的政治偏见。本文先从概念语义和法治语境下阐述“留置”的特殊内涵,并就学界的多种英译表达论述其表达的缺失。究其原因,中西不同权力体系下的话语逻辑存在根本不同,故在监察制度表达上体现出“有限”和“有为”之分。“留置”这一监察强制措施集中体现了中国“有为监察”的特质。而要实现对等英译,就是要在中国特色和国际表达间寻求一种平衡。The substitution of“double regulation”with“retention”in the Supervision Law is a major progress in the fight against corruption under the rule of law,and the crystallization of the wisdom of the Party and the State in anti-corruption in accordance with the practice of Chinese characteristics.However,there is no equivalent English translation of the innovative legal concept of retention.In the struggle between the Chinese and Western discourse system,the supervision and rule of law with Chinese characteristics needs to explain the discourse and discourse logic of supervision and rule of law in the Chinese context,and gradually eliminate the political bias of Western countries in international anti-corruption cooperation.This paper firstly elaborates on the special connotation of retention in the context of conceptual semantics and rule of law,and later discusses the lack of expression in the light of the various English translation in the academic circles.The reason for this is that there are fundamental differences in the discourse logic under different power systems in China and the West.Therefore,the expression of the supervision system reflects the distinction between“limited”and“acti ve”.The compulsory supervision measure of retention embodies the characteristics of“active supervision”in China.To achieve such equivalent English translation is to strike a balance between Chinese characteristics and international expressions.
