我国外籍劳务移民制度构建研究:困境与出路

摘　　要：目前,我国在外国人来华务工方面面临着一些困境,即:来华工作外国人数量持续增长与我国外国人就业制度滞后之间的矛盾,国内劳动力结构性缺失与我国外籍劳务移民制度缺失之间的矛盾,外国人在华非法就业现象愈发严重与国家利益保护之间的矛盾。梳理分析俄罗斯、美国、日本等国家的劳务移民配额制度、配套制度,提出我国外籍劳务移民制度的构建建议:在遵循国家利益主导性原则、国家主权排他性原则、国家政策引导性原则基础上,通过配额制引进外籍劳务移民,科学合理设计签证制度,加强配套制度建设,通过合作增强国际协调性等。At present,China faces some difficulties in the field of foreign labor,namely,the contradiction between the continuous growth in the number of foreigners working in China and the lagging employment system of foreigners in China,the contradiction between the structural shortage of labor force in China and the lack of foreign labor immigration system in China,and the contradiction between the increasingly serious phenomenon of illegal employment of foreigners in China and the protection of national interests.Based on the analysis of the quota system and supporting system for labor migration in Russia,the United States,Japan,this paper put forward suggestions for the construction of China’s foreign labor immigration system:on the basis of following the principles of national interest dominance,national sovereignty exclusivity and national policy guidance,introducing foreign labor immigrants through a quota system,formulating the visa system scientifically and rationally,strengthening the construction of supporting systems and enhancing international coordination through collaboration.
