环境违法举报奖励机制设计之关键要素研究——以“四地”典型文本为主要观察对象

摘　　要：准确把握环境违法举报奖励机制设计的认知准备,以现行具有典型意义的环境违法举报奖励机制“四地”文本为主要样本进行考察,发现环境违法举报奖励机制设计之成功与否主要取决于举报主体、举报要求、举报范围和举报程序等关键要素的相关规定是否完备。目前环境违法举报奖励机制设计之关键要素仍存在举报主体范围不明确、行政主体的义务性规定不全面、举报范围不够具体及举报程序不够完善等问题。在全面落实《关于实施生态环境违法行为举报奖励制度的指导意见》的精神、充分保障举报人权利和发挥激励机制的内在价值的基础上,需进一步确定举报主体范围,补充完善行政主体的义务性规定,适当扩大举报范围及规范具体程序,以建立健全环境违法举报奖励机制。After accurately grasping the cognition of reward mechanism design for reporting environmental violations,based on the typical text of reward mechanisms for reporting environmental violations in“Four Places”as the main sample,we have found that the success of reward mechanism for reporting environmental violations mainly depends on the completeness of relevant provisions of key factors such as reporting subject,reporting requirement,scope and procedure.Currently,there are still some problems in reward mechanism design for reporting environmental violations,such as unclear scope of reporting subjects,incomplete compulsory provisions of administrative subjects,unspecific reporting scope as well as poor reporting procedures.Based on all-round implementation of legislation spirit under Guidelines on Implementation of Reward System for Reporting Ecological and Environmental Violations and full protection of informants’right as well as full play of incentive mechanism of intrinsic value,we need to further determine the scope of reporting subjects,complement compulsory provisions of administrative subjects,appropriately expand the scope of reporting and specific procedures,in order to establish and improve a reward mechanism for reporting environmental violations.
