摘　　要：目的分析医疗纠纷中涉及死亡病例讨论制度的情形,为死亡病例讨论制度有效落实提供参考。方法在“中国裁判文书网”使用高级检索功能,结合人工筛选方法,选取2016年-2020年涉及死亡病例讨论制度的医疗纠纷案例共55起,分析纠纷点,并筛选出3个典型案例进行剖析。结果死亡病例讨论制度执行不到位、死亡病例讨论记录缺失、缺乏临床依据、医院封存病历处置不当等是医疗纠纷主要原因,也是死亡病例讨论制度执行过程中的常见问题。结论医院应提高对死亡病例讨论制度的重视程度,明确死亡病例讨论制度执行要点,推行电子病历,利用DRGs筛查低风险分组死亡病例,有效落实死亡病例讨论制度等。Objective To analyze the situation of death case discussion system in medical disputes,and to provide reference for the effective implementation of death case discussion system.Methods A total of 55 medical dispute cases involving death case discussion system from 2016 to 2020 were selected by using advanced search function and manual screening method on"China Judicial Documents Network".The dispute points were analyzed,and 3 typical cases were selected for analysis.Results The main causes of medical disputes and the common problems in the implementation of the death case discussion system included the poor execution of the death case discussion system,the lack of death case discussion record,the lack of clinical evidence,and the mismanagement of sealed medical records,etc.Conclusion The hospital should pay more attention to the death case discussion system,clarify the key points of the implementation of the death case discussion system,implement electronic medical records,use DRGs to screen low-risk grouping of death cases,and effectively implement the death case discussion system.
