社会法总论思想市场的学术脉络与叙事演变(1978-2018)

摘　　要：改革开放四十年所推动的中国社会发展历史转型,特别是“共同富裕”民生内核发展目标的再次凸显,推动着中国法治思想市场的内涵转型。聚焦1978-2018年间中国社会法总论学术史,借助法循证学方法,按照思想产品的供需关系、生产主体、生产资源配置及叙事主题等思想市场要素指标,对中国社会法总论思想市场的研究发展现状、学术脉络特征及叙事演变轨迹进行文献计量学和叙事学分析。结论显示,中国社会法总论研究正在走出“西法东渐”的法学思想隧道,但社会法总论思想市场的内在结构、运行机制及产品竞争力等还有待完善和提升。中国特色社会法总论研究应不断开拓新的理论疆域,创新叙事话语,培养学术自觉。Driven by the 40 years of reform and opening up,especially the re-emphasis of the development goal of“common prosperity”as the core of people’s livelihood,the historical transformation of China’s social development has triggered the connotation transformation of the market of ideas of China’s rule of law.This paper focuses on the academic history of general social law in China from 1978 to 2018.By using the evidence-based law methodology and considering the indicators of the market of ideas like the supply and demand of the products of ideas,the production subjects,the allocation of production resources and the narrative themes,it conducts a bibliometric and narrative analysis on the present research,academic lineage and narrative evolution trajectory of the market of ideas of general social law in China based on the big-data quantitative empirical research.It concludes that the study of China’s general social law is moving out of the tunnel of legal thought of the“Western law spreading to the East”,but the inner structure,operation mechanism and competitiveness of its market of ideas still need to be improved.The study of general social law with Chinese characteristics should continue to explore new theoretical frontiers,innovate the narrative discourse and cultivate academic self-awareness.
