论黄河法的生成逻辑与路径展开——以“空间思维”为主线

摘　　要：流域治理的整体性为“空间思维”指导流域法治的重塑提供契机。黄河流域特殊的生态环境问题、复杂的环境社会关系、落后的管理体制机制、突出的法律供需矛盾构成黄河法的生成背景,黄河流域的“自然—社会—管理—法律”空间属性成为黄河法的生成动力,循此所生成的黄河法应当具有独立性、系统性、非凡性和中观性特征。在基本理念上,黄河法应当坚持“生态优先、绿色发展”;在管理体制上,黄河法应当修正流域治理与区域治理相结合的主辅关系;在事权配置上,黄河法应当按照“中央—流域—地方”的三维层级界定权责;在制度设计上,黄河法应当对流域基本制度进行体系化。The holistic nature of river governance provides an opportunity for“spatial thinking”to guide the reshaping of rivers’rule of law.The special ecological and environmental problems of the Yellow River,the complex environmental and social relations,the backward management system and mechanism,and the prominent contradiction between supply and demand of laws constitute the background for the creation of the Yellow River Law.The natural spatial attribute,social spatial attribute,management spatial attribute,and legal spatial attribute of the Yellow River become the driving force for the generation of the Yellow River Law,which should be characterized by independence,systematicity,extraordinary and mesoscopic.In basic concept,the Yellow River Law should adhere to the principle of“ecological priority,green development”.In management system,the Yellow River Law amended the primary and secondary relationship between river basin governance and regional governance.In configuration of affairs,the Yellow River Law should be defined in accordance with the three-dimensional hierarchy of“central–basin–local”powers and responsibilities.In system design,the Yellow River Law should systematize the basic system of the river.
