费孝通的“无讼”思想与中国基层社会治理

摘　　要：“无讼”集中体现了古代先贤的社会治理思想和对理想社会关系的追求。费孝通先生将“无讼”视为乡土中国的基本社会特征之一,追求和谐,将矛盾消弭于基层,是中国社会一贯的文化特征。伴随着百年来的社会巨变,中国社会治理仍沿着这条主线展开。特别是新时代以来,从中央到地方都重新检视和吸收中国传统乡土社会中“无讼”的积极因子,将“无讼”理念融入现代社区治理,通过扩大社会参与构建共建共治共享的社区共同体。“无讼社区”建设成为新时代中国城乡一体化背景下基层社会治理的守正创新实践。“No Litigation”embodies the ancient sages’ideas of social governance and pursuit of ideal social relations.In his book From the Soil,Mr.Fei Xiaotong regards it as one of the basic social characteristics of rural China.The pursuit of harmony and resolving conflicts at the grass-roots level has been a consistent cultural feature of Chinese society.Along with 100 years of dramatic social changes,Chinese social governance continues to unfold along this main line.Especially since the new era,from the central to the local level,the positive factor of“No Litigation”in the traditional Chinese rural society has been re-examined and absorbed.The construction of a“community without litigation”has become an innovation of grass-roots social governance in the context of urban-rural integration by combining the traditional Chinese concept of“No Litigation”with modern community governance,expanding social participation,and creating a community that is co-built,jointly governed,and enjoyed together.
