论生产安全事故的国家赔偿救助责任——从《中华人民共和国安全生产法》法律责任切入

摘　　要：我国生产安全事故建立了生产经营单位负责、行政监管、职工参与、行业自律和社会监督相配合的管理制度,其中,行政监管是公权力行使职能的重要体现。实践中,我国生产安全事故多以生产经营单位为主要赔偿救助主体,对违法违规行政监管导致损害的赔偿救助不足,国家赔偿救助存在制度困境,亟待肯定行政监管部门对生产安全事故的赔偿救助责任,明确行政部门违法违规监管与事故损害结果关系的认定规则,建立事故受损者先行申请国家赔偿救助、行政部门后续追偿制度,完善生产安全事故国家赔偿救助责任体系。The national production safety accident has established a management system that is responsible for production and business units,administrative supervision,employee participation,industry self-discipline and social supervision.Among them,administrative supervision is an important manifestation of the function of public power.In practice,most of the production safety accidents in our country are mainly based on the production and business units as the main compensation and assistance body,and the compensation and assistance for the damage caused by the violation of the law and the administrative supervision is insufficient,and the state compensation and assistance has a systemic dilemma.It is urgent to affirm the responsibility of the administrative supervision department for compensation and rescue of production safety accidents,and clarify the rules for determining the relationship between the illegal supervision of the administrative department and the accident damage result,establish a system for those injured in the accident to apply for national compensation and assistance in advance,and for the administrative department to follow-up recovery,improve the national compensation and rescue responsibility system for production safety accidents.
