信用法治视角下的共享经济监管

摘　　要：共享经济是近年来我国经济发展的一种新业态、新模式。由于共享经济对于传统经济运行模式的颠覆,产生了监管的时滞,建立在传统经济运行模式语境下的监管制度并不能对共享经济发展所带来的一系列问题作出有效回应。共享经济带来了产业融合、多元参与主体、全地域服务以及技术驱动的趋势。从共享经济的运行规律来看,信用机制对于交易达成产生了重要作用。共享经济监管应当更加注重信用监管机制的运用,这既符合共享经济的发展方向,也是建设诚信社会的客观要求。而基于这一路径,则需要公权与私权的合作,建立相应的信任机制,推动信用监管法治化,加强信息互动,构建信任、包容、普惠的信用法治秩序,进而促进共享经济发展。The sharing economy is a new form and mode of China’s economic development in recent years.Due to the subversion of the traditional economic operation mode by the sharing economy,there is a time lag in regulation,and the regulatory system based on the traditional economic operation mode can not effectively respond to some problems brought about by the development of the sharing economy.The sharing economy brings about industrial integration,multiple participants,all-regional services and technological self-reliance.From the perspective of the operation of the sharing economy,social credit mechanism plays an important role in the conclusion of transactions.Therefore,the current regulation of the sharing economy can adopt the construction path of rule of law of social credit.This is not only in line with the inherent development requirements of the sharing economy,but also the objective requirements of building an honest society.Based on this,it is necessary to build the cooperative relations between the public sectors and the private sectors,establish corresponding trust mechanism,promote the legalization of integrity tools,strengthen information interaction,and build inclusive integrity order,so as to promote the development of the sharing economy.
