无期徒刑如何兑现“无期”——以死刑替代功能之充分发挥为着力点

摘　　要：限制死刑适用方面的重要举措之一就是设置死刑替代措施,而与死刑的严厉程度和威慑效果最为接近的无期徒刑理应发挥立法上最佳的死刑替代功能。鉴于目前中国刑法中规定了减刑和假释制度,实际上使得无期徒刑并非“无期”,从而影响了死刑替代功能的良好发挥。因此,对无期徒刑进行改进,设立终身监禁型的无期徒刑实属应有之义。《刑法修正案(九)》启动了立法试点,对特别重大贪污贿赂犯罪引入终身监禁制度乃是一大亮点,应当以此为契机,进一步探讨终身监禁适用范围之扩大,从而使无期徒刑的制度设计真正做到名副其实、名至实归。One of the important measures limiting the application of the death penalty is the introduction of replacement measures to the death penalty,life sentence,which is closest to the severity and deterrent effect of death penalty,should play a legislative replacing function of death penalty.In view of the system of commutation and parole in Chinese criminal law makes life sentence not “perpetual”,then it affects the function of replacing the death penalty.Therefore,the improvement of life sentence and the establishment of life imprisonment should be justified.《Amendments to the Penal Code(IX)》pilot legislation conducted,which to introducting life imprisonment for particularly important corruption and bribery crimes,This should be an opportunity that further explore the extension of life imprisonment,so that the system of life sentence can be truly designed.
