新专利法背景之下中国药品专利保护期补偿品种预测研究

摘　　要：新专利法背景之下,筛选出加拿大、日本和韩国三国获批药品专利保护期限延长的品种及加拿大和日本两国获批药品专利保护期限延长的品种的整体信息,在近3年里获准的药品专利保护期补偿的品种中,这9种被推测为应该是上市持有者最急于获得保护的品种,从中汲取对中国新药研发的启示,为我国新专利法实施后的新药研发提供专利规避的数据支撑。Under the background of the new patent law, this article screens integrated information of drugs with patent time extended in three countries of Canada, Japan and Korea, and in two countries of Canada and Japan through databases. In recent three years, there are 9 kinds of drugs with patent time extended, which are predicted to be the most eagerly obtained category by the holders. There is inspiration from the information for new drug research and development in China. Data support is provided for patent circumvention of new drug research and development after new patent law is implemented in China.
