摘　　要：迈入数字文明新阶段,数据已经成为关键性、基础性生产要素,但数据管理制度较为滞后、数据市场构建面临诸多困难,导致数据确权、数据交易、数据伦理、数据算法及公平与效率等一系列相关问题凸显,亟须建立与数据时代发展相适应的数据制度体系和管理规则。本文立足当前国内外发展形势和数字化发展趋势,提出建立中国特色社会主义数据所有权制度——共有制,从而推进数据基础制度体系构建,旨在进一步激发数据要素潜能和价值,不断提高我国的数字化建设能力,创造新的国际竞争优势。During the new stage of digital civilization,data has become a key and essential production factor.However,due to the lagging data management system and the difficulty in building a data market,problems such as data rights confirmation,data transactions,data ethics,data algorithms,and fairness have become prominent.With the occurrence of a series of related problems such as efficiency,it is urgent to establish a data system and management rules that are compatible with the development of the data era.Based on the current development situation at home and abroad and the trend of digital development,this paper proposes establishing a socialist data ownership system with Chinese characteristics-the co-ownership system.This system promotes the construction of the basic data system,further stimulating the potential and value of data elements and continuously improving our country's digital construction ability to create new international competitive advantages.
