摘　　要：随着国际数字服务贸易的快速发展,世界主要国家都制定了针对数字服务贸易的限制性管理措施。这些数字服务贸易限制措施的规则关系到国际数字服务贸易规则框架的构建和我国相关的话语权。通过比较国际数字服务贸易壁垒的主要形式——跨境数据流动限制、数字服务企业的市场准入限制和数字税的征收管理措施,发现美国主张数字服务贸易的自由开放和争斗国际规则的主导权,而欧盟国家出于维护自身数字企业的发展利益,更趋向于制定限制性管理措施。中国一方面要发展数字经济,提升数字化企业的核心竞争力;另一方面需要积极完善国内数字经济立法,主动参与国际数字服务贸易规则的制订。With the rapid development of international digital service trade,major countries in the world have formulated restrictive management measures for digital service trade.The rules of the restrictive measures of digital service trade in major countries are related to the building of a framework for digital service trade and the improvement of China's voice in global digital service trade rules.By comparing the main forms of international digital service trade barriers—restrictions on cross-border data flow,restrictions on market access of digital service enterprises and collection and management measures of digital tax,the article finds that the United States advocates the freedom and openness of digital service trade and the dominance of international rules,while EU countries tend to formulate restrictive management measures to safeguard the development interests of their own digital enterprises.On the one hand,China should develop its digital economy and improves the core competitiveness of digital enterprises;On the other hand,we need to improve domestic digital economy legislation and participate in the formulation of international digital service trade rules actively.
