摘　　要：开放著作权是著作权保护不断强化过程中的一种“逆向性”理念。开放软件、创作共享已取得广泛影响。作为著作权法基本框架下的变通机制,单方允诺许可有助于构建灵活多样的著作权交易机制。单方允诺之债的效力得到民法学界普遍认可。单方允诺著作权许可是自愿许可,不同于法定的强制性付酬许可;著作权人一旦发出单方允诺,就具有法律效力。国外著作权纠纷判例已明确支持这种单方允诺的有效性。《著作权法》可明确承认单方允诺模式的法律效力,既便于著作权行使,也可保障相对人的信赖利益,并达到促进交易效率、维护交易秩序之目的。Open copyright is an alternative approach to conventional copyright in the process of the continuous strengthening of copyright.While open software and creative commons achieving widespread infl uence,as a fl exible mechanism based on copyright law,the unilateral-contract-mode is helping to build a flexible and diversified copyright mechanism.The validity of unilateral promise is generally recognized in the academic world of civil law.Copyright license of unilateral promise is a voluntary licensing,which is different from the compulsory and paid-licensing under statute.Once a unilateral promise is issued by copyright owner,it has a legal effect.Some judicial judgments abroad have clearly upheld the validity of unilateral promise.For future revision of Copyright Act of China,It shou ld be better to clearly recognize the legal validity of unilate ral promise,which will not only facilitates the exercise of copyright,but also protects the reliance interests of the counterparts,and helps to promote trading effi ciency and maintain market order.
