摘　　要：习近平法治思想中的立法理论筑基于全面依法治国的实践之上,形成于习近平总书记对立法工作所作出的一系列重要论述之中。习近平法治思想中的立法理论所具有的立场指向与具体思路,清晰地阐释了我国立法的本体世界。其立场指向主要从领导主体、权益指向和路径选择方面进行三元定位。其理论思路主要包括方向性思路、方法性思路和技术性思路。其在科学立法、民主立法、依法立法方面引领立法方向;在系统立法、专业立法、立法监督方面突出立法方法;在推动党内法规体系的完善、引领法典化立法、促进重点领域立法等方面提供技术供给。在未来立法实践中,全面落实习近平法治思想中立法理论的立场指向与思路,对实现“良法”目标具有方向性意义。The legislative theory of Xi Jinping’s thought on rule of law is based on the practice of comprehensive rule of law,and is formed in a series of important discussions on legislative work made by General Secretary Xi Jinping.The legislative theory in Xi Jinping’s rule of law thought has a clear standpoint and specific thinking,which clearly explains the ontological world of China’s legislation.Its standpoint is mainly based on the three-dimensional positioning of the leadership subject,the rights and interests direction and the path selection.Its theoretical ideas mainly include directional ideas,methodological ideas and technical ideas.It leads the direction of legislation in scientific legislation,democratic legislation and law-based legislation;it highlights legislative methods in systematic legislation,professional legislation and legislative supervision;it provides technical supply in promoting the improvement of the party regulations system,leading codified legislation,and promoting legislation in key fields.In the future legislative practice,the comprehensive implementation of the legislative standpoint and thinking of the legislative theory of Xi Jinping’s thought on rule of law has directional significance for achieving the goal of“good law”.
