软硬法制度文本中高校专门学术委员会设置的比较——基于16所高校学术委员会章程的分析

摘　　要：软硬法混合治理是高等学校教授治学法治化的重要特色,如何设置专门学术委员会是高校教授治学软硬法在学术委员会组成规则方面的重要内容,通过对16所高校学术委员会章程中专门学术委员会的设置与硬法《高等学校学术委员会规程》进行比较,发现各高校制定的软法制度文本呈现出一致、部分一致、缺失等多样性。分析发现,硬法文本没能完全回应专门学术委员会的现实软法立法需求,硬法文本语言过于注重灵活性,原则性相对缺乏,部分高校学术委员会章程中专门学术委员会组成规则制定随意是当前高校教授治学制度文本的主要问题。这些问题一方面与法律的完善本身是一个过程有关,另一方面也与相关软法立法撰写与审议缺乏专业人士参与、过程缺乏核定环节有关。为完善软硬法制度文本中关于专门学术委员会设置的内容,应加强法理学研究,注重总结实践经验,做到软硬法立法有理有据;应软法“硬”立,完善高校学术委员会章程的校内审议与校外核准程序;应准确使用法律语言,坚持原则性与灵活性相统一。The mixed governance of soft and hard law is an important feature of the law about professor's academic governance in colleges and universities.How to set up some specialized academic committees is the main content of soft and hard law about professor's academic governance.Comparing the establishment of the specialized academic committees in the constitution of academic committees of 16 colleges and universities with the Rule of the Academic Committee of Colleges and Universities,it is found that the content of their specialized academic committees in the constitution of academic committees of 16 colleges and universities investigated shows the diversity.Some of them show consistency and some show partial consistency and some show conflict.One of the reasons is that hard law text cannot fully respond to the actual requirements of the soft law about the constitution of academic committees.The other reason is the language of hard law text is too flexible to provide the basis for the relevant soft law,and the third reason is lack of participation of professional members in the writing and deliberation of relevant soft law and lack of verification during the process of the rule form process.In order to perfect the text of the soft law and hard law about professor's academic governance,we should reinforce the jurisprudence research and summarize practical experience so that make the legislation of soft and hard law reasonable and make hard law give soft law strong support.The soft law of constitution about professor's academic governance should improve the interior deliberation in colleges and universities and add external approval procedure,and legal language should be used accurately and follow the rule of the unity of principle and flexibility.
