摘　　要：建立失信惩戒制度是维系社会信用体系的必然选择,在惩戒的同时也应注重保护失信人的人格权。为了更好地实现失信惩戒效果与人格权保护之间的平衡,通过分析惩戒措施在一定程度上对失信人人格权的影响,探讨失信惩戒制度中的人格权保护路径。立足于当前失信惩戒制度运用实践,从坚守底线思维、加快社会信用立法、遵循“比例原则”与“不正当连结禁止原则”4个方面探索完善失信惩戒制度中的人格权保护路径,促进失信惩戒制度在法制框架内更有效地发挥引导作用。It is an inevitable choice to establish a disciplinary system for dishonesty to maintain the social credit system.In order to better realize the balance between the effect of disciplinary for dishonesty and the protection of personality right,this paper discusses the protection path of personality right in disciplinary system for dishonesty through analyzing the influence of disciplinary measures on the personality right of dishonest people to a certain extent.Based on the practice of the current disciplinary system for dishonesty,it proposes to stick to the bottom line thinking,speed up the social credit legislation,follow the“proportionality”and“improper link no principle”,so as to perfect the protection path of personality right in disciplinary system for dishonesty,promote disciplinary system for dishonesty to play a guiding role within the legal framework more effectively.
