家事审判改革的路径与发展方向

摘　　要：中国家事审判改革自2016年正式拉开帷幕,至2018年,通过全国各试点法院的实践,探索出一系列可行的制度,包括以修复人伦关系为出发点的家事调解制度、诉讼离婚冷静期制度、家事调查员制度、离婚财产申报制度等。2021年,《民法典》正式施行,其对离婚冷静期、调解制度和未成年人保护问题等作出明确规定,肯定了家事审判改革的成果,但依旧存在一些问题。接下来应当重视改革措施的成本收益分析,否则会导致法院不堪重负。未来改革的基点依旧是家事调解,重心应放在调解策略上,将案件事实之外的人伦资源嵌入诉讼程序之中,以一种“修复式列举优点”的调解策略实现“人伦司法”,以达成维护婚姻家庭关系稳定之目标。Since 2016,the reform of our national family trial officially has begun,and by 2018,a series of feasible systems have been explored through the practice of pilot courts across the country,including the family mediation system with the starting point of repairing human relationships,the litigation divorce cooling-off period system,the family investigator system,and the divorce property declaration system.In 2021,the Civil Code came into force,and its clear provisions on the divorce cooling-off period,mediation system and the protection of minors have affirmed the achievements of the family trial reform,but some problems still exist.The next step should be to pay attention to the cost-benefit analysis of reform measures,otherwise it will lead to overburdened courts.The base of future reform is still family mediation,and the focus should be on mediation strategies,embedding human resources beyond the facts of the case into the proceedings,and achieving’human justice’with a mediation strategy of’restorative enumeration of merits’in order to achieve the goal of maintaining stable marital and family relationships.
