我国赡养协议制度的适用与立法完善

摘　　要：我们国家已迈入到老年型国家和人口长寿时代,且人口还具有“未富先老”“未备先老”的特点,而我国法律关于老年人赡养制度的相关规定还存在内容比较粗略,标准比较模糊,条件比较生硬,在执行上弹性比较大的问题,需要通过立法途径扩大赡养协议签订的主体范围、明确赡养协议的必备内容、细化赡养协议的适用情形、强化赡养协议的履行监督、建立赡养激励机制和允许解除赡养协议等,全面完善我国赡养协议法律制度,以满足新时代我国老年人特别是农村老年人养老法律保障的需要。China has entered an age of aging and longevity,and the population is characterized by"getting old before getting rich"and"getting old before getting ready".However,there are still some problems in the relevant provisions of the elderly support system in China’s laws,such as rough content,vague standards,stiff conditions and relatively flexible implementation.It is necessary to expand the scope of the main body of the support agreement,clarify the necessary content of the support agreement,specify the application of the support agreement,strengthen the supervision of the implementation of the support agreement,establish the support incentive mechanism and allow the termination of the support agreement,so as to comprehensively improve the legal system of the support agreement in China in order to meet the needs of legal protection for the aged in China,especially in rural areas in the new era.
