构建上合组织内部争端解决机制探析

摘　　要：2017年上合组织接收印巴加入实现了首次扩员。扩员后的上合组织内部成员间争端显著增多,且上合组织尚无解决争端的机制,上合组织构建争端解决机制已是当务之急。结合解决国际争端常用方式的特征和上合组织具体情况,上合组织可以灵活采用政治方式、国际仲裁方式和混合方式解决其内部争端。从机制建设上看,上合组织可以建立贯穿争端解决始端、中端和末端的“三位一体”争端解决机制,即争端预防机制、争端管控机制和争端解决机制。预防机制旨在预防成员间的分歧争端化,而管控机制则能有效避免争端冲突化,解决机制则致力于争端的最终解决。“三位一体”争端解决机制的构建对上合组织意义重大,有该机制的“护航”,上合组织必将迎来更美好的明天。In 2017, the Shanghai Cooperation Organization(SCO) began its first expansion by accept India and Pakistan. After this expansion, the disputes among members increased significantly. As SCO has no mechanism to resolve disputes, to establish a mechanism is an urgent task for SCO. In light of the common methods for resolving international disputes and the specific situation of SCO, SCO can adopt a dispute resolution mechanism that runs through the the entire dispute resolution---dispute prevention mechanism, dispute management mechanism, and dispute resolution mechanism---to prevent the disputes among members, to effectively avoid the conflicts of disputes, and to finally settle disputes. An establishment of such a dispute settlement mechanism will surely usher in a better future for SCO.
