《民法典》时代涉外收养制度的优化

摘　　要：《民法典》已于2021年1月1日起正式施行,包括《收养法》在内的多部法律已全部废止,收养的法律关系适用《民法典》的相关规定。《民法典》对收养的相关条款进行了实质性修改,一方面符合我国的相关政策,另一方面也更加注重对被收养人权益的保护。然而,就《民法典》对涉外收养的规定来看,还存在空白之处。在《民法典》时代,通过对涉外收养的国际最新发展趋势进行分析与归纳,在结合我国现实国情的基础上,以儿童利益最大化原则为出发点,对我国的涉外收养制度进行完善。The Civil Code has been formally implemented on January 1,2021,and many laws including the Adoption Law have been repealed.The legal relationship of adoption shall be governed by the relevant provisions of the Civil Code.The Civil Code has made substantive amendments to the relevant provisions of adoption.On the one hand,it is in line with my country’s relevant policies.On the other hand,it also pays more attention to the protection of the rights and interests of adoptees.However,as far as the Civil Code provides for foreign adoption,there are still gaps.In the era of Civil Code,by analyzing and summarizing the latest international development trends of foreign adoptions,combining with actual national conditions,and starting from the principle of maximizing children’s interests,my country’s foreign adoption system has been improved.
