论智能应用程序使用中个人信息权益的保护

摘　　要：个人信息是人存在于社会并参与社会活动的必要工具,合理充分利用个人信息是推动数字经济健康发展的前提。随着互联网行业的蓬勃发展,智能应用程序对个人信息攫取无度的问题也随之而来,若不解决,一方面可能使得社会隐形歧视在大数据算法的作用下愈演愈烈,另一方面对于信息主体的自决权和人身财产安全也造成了侵害可能。在信息处理活动中,信息主体相较于信息处理者而言处于弱势地位,故应从保护弱势一方权益的角度出发,通过扩充信息主体救济途径,增加信息处理者保护个人信息权益的义务以及要求相关政府部门主动介入对个人信息权益保护的方法,实现信息处理活动中权利与义务的合理分配,从而更有针对性地破解信息主体权益得不到保障的困境。Personal information is a necessary tool for people to exist in the society and participate in social activities.Reasonable and full use of personal information is the premise to promote the healthy development of the digital economy.With the booming development of the Internet industry,the problem of the personal information grabbed excessively by mobile Internet applications also follows.If it is not solved,on the one hand,it may make social invisible discrimination more and more intense under the action of big data algorithms,and on the other hand,it may also cause infringement on the right of self-determination and personal and property safety of the information subjects.In the information processing activities,the information subject is in a weak position compared with the information processors.Therefore,from the perspective of protecting the rights and interests of the vulnerable party,we should expand the relief channels of information subjects,increase the obligations of information processors to protect personal information rights and interests,and require relevant government departments to actively intervene in the protection of personal information rights and interests,to realize the reasonable distribution of rights and obligations in information processing activities,so as to more targeted crack the dilemma that the rights and interests of information subjects can not be guaranteed.
