我国船员外派机构规制的法律问题研究

摘　　要：外派机构作为连接外派船员和境外船东的重要主体,在履行连接外派船员和境外船东的主体义务中存在外派机构法律定位模糊、外派机构的责任划分不明确、职责履行缺乏监管等问题。因此,交通运输管理部门应在规章制定层面明确外派机构的法律定位,界定外派机构与境外船东承担连带责任的法定情形,在执法层面,海事管理机构应从加强对外派机构的资质审查、履职监督以保证船员外派信息透明的监管等。As an essential subject connecting dispatched seafarers and foreign shipowners,crew expatriate agencies have problems in fulfilling the main obligation such as ambiguous legal positioning of crew expatriate agencies,unclear division of responsibilities of crew expatriate agencies,and lack of supervision in the performance of duties.Therefore,the Administrate Ministry of Transport should clarify the legal position of the crew expatriation agencies at the level of rule-making,and define the legal situation in which the crew expatriation agencies and the foreign shipowner bear joint and several liability.At the law enforcement level,maritime administrations should strengthen the qualification review and duty performance supervision of crew expatriation agencies to ensure the transparency of information.
