摘 要:信息化时代,在个人信息价值不断提升的同时,网络著作权信息披露制度的重要性日益凸显,但我国立法中有关著作权信息披露的规定却仍显滞后,缺乏明确和完备的披露程序和条件的规定。其他一些国家对网络著作权信息披露制度进行了较为科学和合理的设计,值得我国借鉴。我国应通过对《信息网络传播权保护条例》第13条和第25条的修订来重构著作权信息披露制度:应规定著作权人有权请求网络服务提供者披露侵权人信息,对行政机关行使信息披露权进行限制,同时明确规定可以通过人民法院行使信息披露请求权,并且应明确信息披露请求权的具体行使要件。In the information age,while the value of personal information continues to increase,the importance of the online copyright information disclosure system has become increasingly prominent.However,the provisions on copyright information disclosure of Chinese legislation are still lagging behind,and there is a lack of clear and complete disclosure procedures and conditions.Some overseas countries have carried out relatively scientific and reasonable designs for the online copyright information disclosure system,which is worthy of reference for China.China should reconstruct the copyright information disclosure system by revising Articles 13 and 25 of the Regulations on the Protection of the Right of Information Network Communication:it should be stipulated that the copyright owner has the right to request the network service provider to disclose the information of the infringer,and the exercise of the right of information disclosure by administrative organs should be restricted.At the same time,the right to request information disclosure should be exercised through the court,and the specific requirements for exercising the right to request information disclosure should be specified.
