农民工劳动争议诉求渠道选择的代际差异与影响因素研究

摘　　要：研究利用“新时期农村转移劳动力职业发展与劳动关系研究”课题组调查数据,考察新生代农民工和老一代农民工劳动争议诉求渠道选择的异质性,重点探讨影响两代农民工争议诉求渠道选择的因素及其差异。研究结果显示,相比老一代农民工,新生代农民工更倾向于利用法制化手段实现劳动权益维护诉求,导致新老两代农民工在争议诉求渠道选择上产生差异的原因不仅来自于年龄效应的影响,还存在世代效应的影响,即世代间教育程度、劳动合同权益保障状况、工资权益保障状况以及迁移意愿的差异影响了农民工争议诉求渠道的选择。在实证结论基础上,研究提出应加强对农民工法律知识培训和法律援助的力度;切实维护农民工劳动权益,尤其是工资社保、劳动安全等底线性权益;为农民工在城市工作生活提供更多制度保障与便利条件,提高其城市适应性。The research uses the data obtained from“Research on Occupational Development and Labor Relations of Rural Migrant Workers in the New Era”to examine the heterogeneity of the choice of labor dispute appeal channels for the new generation of migrant workers and the older generation of migrant workers, focusing mainly on factors and differences in choosing the channels of disputes and appeals for the migrant workers. The research results show that compared with the older generation of migrant workers, the new generation of migrant workers are more inclined to adopt legal means to achieve the labor rights protection claims, and the reasons for the differences between the new and old generations of migrant workers in the choice of dispute appeal channels not only come from the effects of age, but also the effects of cohort effects, that is, the choice of channels for migrant workers’ disputes is affected by differences in education levels between generations, labor contract rights protection status, wage rights protection status, and migration willingness. Based on the findings of empirical research, the study proposes that the legal knowledge of new-generation migrant workers and the legal assistance to older migrant workers should be strengthened;the labor rights and interests of migrant workers, especially the bottom-line rights and interests such as wage social security and labor security should be earnestly safeguarded;institutional guarantees and convenient conditions for new-generation migrant workers to work and live in cities should be provided to improve their urban adaptability.
