摘　　要：劳动者个人信息保护是劳动法和个人信息保护法的重要内容。根据个人信息保护法的规定,“告知—同意”规则是劳动者个人信息保护的核心,同时需要根据“合法、正当、必要”原则进行审查保护。但在实践中,“告知—同意”规则的告知步骤流于形式,劳动者同意的意思表示不真实,“告知—同意”规则的例外被用人单位滥用,用人单位收集处理劳动者个人信息不符合“合法、正当、必要”原则的要求,使得劳动者的个人信息无法得到真正保护。需要完善“告知—同意”规则,明确“合法、正当、必要”原则的内涵,限制用人单位滥用权利,提高劳动者的理解能力和协商能力,保障劳动者的同意意思表示真实,联合工会、政府和法院等多方对劳动者的合法权益进行保护。The protection of workers’ personal information is an important content of Labor Law and Personal Information Protection Law. According to the provisions of the Personal Information Protection Law, the notification-consent rule is the core of the protection of workers’ personal information and should be reviewed and protected according to the principle of “legality, justification and necessity”. In practice, however, the notification step of the “notification-consent” rule is only a formality;the intention of the employee’s consent is unreal;the exception to the “notification-consent” rule is abused by the employers;the employers’ collection and handling of the employees’ personal information does not meet the requirements of the principle of “legality, legitimacy and necessity”,thus making the employees’ personal information not truly protected. It is necessary to improve the “notification-consent” rule, clarify the connotation of the principle of “legality, legitimacy and necessity”,restrict the abuse of rights by employers, improve the understanding and consultation ability of employees, ensure that employees’ consent intentions are real, cooperate with trade unions, governments and courts to protect the legitimate rights and interests of employees.
