摘 要:工伤预防可体现诸多社会性价值,立法激励工伤预防具有正当性。但是,无论对于用人单位、科研人员还是服务组织而言,从事工伤预防事业都是不经济的,故需要通过立法加以激励。我国现行的工伤预防激励法律制度,存在着激励主体不明确、激励对象有失片面、激励标准未合理设置、激励方式配置失衡、激励程序几乎缺位、激励责任空白、激励资金受限严重等问题。当前,应通过逐条明确激励主体、适当拓宽激励对象、合理设置激励标准、平衡配置激励方式、全面完善激励程序、明晰规定激励责任、强化保障激励资金等路径,不断完善工伤预防激励法律制度。The prevention of work-related injury has many social values,but is not economic for employers,researchers and service organizations,so legislation incentive is necessary.The current legal system that encourages the prevention of workrelated injury in China has some problems,such as unclear incentive subject,partial incentive object,unreasonable incentive standard,imbalance of incentive methods,absence of incentive procedure,blank incentive responsibility and serious incentive fund limitation.In this regard,we should clarify incentive subjects,broaden incentive objects,set up reasonable incentive standard,balance the allocation of incentive methods,perfect the incentive procedure,clearly stipulate the responsibility of incentive,and strengthen the guarantee of incentive funds,so as to improve the legal system of work-related injury prevention incentive.
