摘　　要：传染病患者遗体处置的公共卫生政策既是医学问题,也是政治难题,考验着政府治理能力。我国现行法律法规对传染病患者遗体处置的相关规定,尚不足以应对新冠肺炎疫情带来的挑战。新冠肺炎疫情暴发以来,我国卫健、民政等政府部门处置新冠肺炎患者遗体的主要依据是规范性文件。该做法与域外的新冠肺炎患者遗体处置方式存在着差异,相关制度的设计、启动、落实在科学性、正当性方面需要进一步补强。当前,在传染病患者遗体处置这一特定殡葬领域,需要通过制定科学的公共卫生政策、尊重个体权利、提升法律制度系统性协同性等方式,不断完善我国的公共卫生和殡葬制度,以便有效应对常态化的疫情防控。The public health policy on the disposal of the corpse of patients with infectious diseases is not only a medical problem,but also a political problem,which is a test for the governance ability of government.The current legal provisions and administrative regulations about corpse disposal for infectious disease patients cannot fully handle the cases of Covid-19 patients.After the outbreak of Covid-19,corpse disposal of Covid-19 patients in China follows regulatory documents by related authorities,different from other countries,and the design,start and implementation of relevant systems need to be further reinforced in terms of scientificity and legitimacy.At present,efforts should be made in making scientific public health policy to pay respect to individual rights,and to improve systematization and synergy of legal systems for corpse disposal of infectious disease patients,so as to promote healthier growth of public health services and funeral services.
