摘　　要：自然资源资产产权市场化可发挥市场在资源配置中的决定作用。将可资产化的自然资源进行统一确权登记后,投至市场公平地进行产权交易,既能形成合理的自然资源有偿使用价格,又能促进自然资源高效利用。本文通过对我国土地、水、矿产、林业等自然资源资产产权市场化的实践现状进行分析,发现大部分自然资源资产产权的市场交易受政府支配的程度较深;在确权登记过程中,面临操作流程不明、确权标准不一、资源分类体系存在重合之处、已有行业标准之间缺乏协调等问题,无法应对权属交叉的难题。因此,除运用《民法典》推动我国自然资源资产产权市场化外,还应采取矫正政府在产权交易中的定位、健全交易环境等措施,进一步促进自然资源资产产权市场化。The marketization of property rights of natural resources assets can play the role of market in determining resource allocation.After the assetable natural resources are uniformly confirmed and registered,they are put into the market for fair property rights transactions,which can not only form a reasonable price for the paid use of natural resources,but also promote the efficient use of natural resources.Through the analysis of the current practice of marketization of property rights of land,water,minerals,forestry and other resources assets in China,it is found that most of the market transactions of property rights of natural resources assets are deeply dominated by the government.In the process of right confirmation and registration,it is faced with problems,such as unclear operation process,different right confirmation standards,overlapping resource classification systems,lack of coordination among existing industry standards and so on,which can't cope with the problem of ownership overlapping.Therefore,in addition to using the Civil Code to promote the marketization of property rights of natural resources assets in China,measures should also be taken to correct the government's position in property rights transactions and improve the measures to ensure the transaction environment,so as to further promote the marketization of property rights of natural resources assets.
