摘  要:由于在行政处罚归责原则的认识上仍存在诸如孤立看待归责条款、未确立系统性思维,忽略归责事由与归责原则的区别以及对刑法、民法理论的错误理解等不足,学界尚未完成对行政处罚领域客观归责原则的充分批驳。通过对行政处罚法第2条、第4条以及第33条第2款的分析可知,现行法采用的是过错推定形式的主观归责原则,而真正意义上的“客观归责”无法适用于行政处罚法领域。现行行政处罚法的一个重要问题是泛化适用过错推定原则,这有违现代行政法“限制公权力、保障人权”的核心价值。由此,行政处罚法应将采用完全的主观归责原则作为其改进方向。Due to the fact that systematic thinking has not been established;ignoring the difference between the cause of imputation and the principle of imputation, as well as the misunderstanding of criminal law and civil law theory, the academic community has not yet completed the full rebuttal of the so-called principle of objective imputation in the field of administrative penalty. Through the systematic analysis of articles 2, 4and 33, paragraph 2 of the Administrative Penalty Law, it can be concluded that the current Administrative Penalty Law adopts the principle of subjective imputation in the form of presumption of fault. Through the cross-observation of criminal law and civil law theory, it can be seen that the real sense of "objective imputation" cannot be applied to the field of Administrative Penalty Law. A major problem with the current Administrative Penalty Law is the generalization of the principle of presumption of fault, which violates the core value of modern administrative law of "restricting public power and protecting human rights". The adoption of the principle of complete subjective attribution should be taken as the development direction.
