论《建筑法》绿色化立法应然目标与实然缺陷

摘　　要：在依法治国的背景下,建筑业绿色发展必然要求《建筑法》的绿色化。《建筑法》绿色化议题不是空泛的抽象话题,其立法内容应涵括节约能源资源、环境保护、低碳发展、保障环境健康以及历史文物建筑保护修缮等五个具体应然目标。随着绿色立法应然目标的清晰化,构建起对现行《建筑法》绿色立法内容进行评价的标准。通过对《建筑法》文本的分析,发现其目的条款缺乏促进建筑业绿色责任实现的意思表达,有关绿色立法规定缺乏刚性且内容简陋,未遵循法制统一性原则进行绿色立法等实然缺陷。通过对《建筑法》绿色立法应然目标与实然缺陷的研究,提出了《建筑法》绿色修法的三条具体对策建议。In the context of the law-based governance of the country,the green development of construction industry inevitably requires the greenization of Construction Law of People’s Republic of China,but this issue is not a vague and abstract topic.Five specific should-be goals should be taken into the legislative content,including the conservation of energy resources,the environmental protection,the low-carbon development,the protection of environmental health,and the preservation and repair of historical relics and buildings.As the should-be goals of green legislation are clearly defined,a standard to evaluate the content of the green legislation of Construction Law of People’s Republic of China is to be established.By means of textual analysis of it,the paper finds out the actual defects in the green legislation that the purpose clauses in the text lack the expression to promote the realization of green responsibility in the construction industry,the rigid rules of relevant green legislation are few and superficial,and that the green legislation doesn’t follow the principle of legal unity.Finally,three specific countermeasures for the green revision of Construction Law of People’s Republic of China are put forward on the basis of the study of the should-be goals and actual defects in the green legislation.
