《民法典》背景下我国离婚救济制度的构建与发展

摘　　要：离婚救济制度是法律为保障当事人因离婚出现受损或经济困难而获得救济的一种法律制度,有利于婚姻当事人实现实质公平。家务劳动补偿制度不受夫妻共同财产的约定,肯定了家务劳动的社会价值;经济帮助制度继续为生活困难一方提供最后一道救济屏障;损害赔偿制度适用范围得到拓展;确定无过错方原则的法律适用。当前制度模式仍需进一步予以完善,以便更好地维护婚姻整体利益和良性发展,创建和谐有序的社会主义婚姻家庭核心价值观。Divorce relief system is a legal system ensuring the parties to obtain relief due to damages or economic difficulties caused by divorce,which is beneficial to the parties of the marriage to achieve substantial fairness.The housework compensation system is not subject to the agreement on the common property of husband and wife,which affirms the social value of housework.The economic assistance system continues to provide the last relief barrier for the party in need.The scope of application of the compensation system for damages has been expanded.And the legal application of the principle of no-fault parties is determined.The current system model still needs to be further improved in order to better safeguard the overall interests and benign development of marriage,and create a harmonious and orderly core values of marriage and family.
