试探医患纠纷司法调解制度之完善——基于31省市28151例司法案件的实证分析

摘　　要：实证分析医患纠纷司法调解案,总结出我国的相应调解制度存在:公立医院院内调解能力有待提升,人民调解组织的功能未充分发挥,部分区域医患纠纷问题较为严重,医患纠纷法规制度还不完善等问题。故应提升院内调解能力、加强人民调解组织建设、发挥司法专家权威的作用、健全针对性地法规制度,加强法律法规的宣传教育。This paper empirically analyzes the judicial mediation cases of doctor-patient disputes and summa⁃rizes the existing problems in the corresponding mediation system in China:mediation ability in public hospitals needs to be improved;the functions of people's mediation organizations have not been fully brought into play;doc⁃tor-patient disputes in some regions are serious;and the legal system of doctor-patient dispute is not perfect.There⁃fore,we should enhance the ability of internal mediation,strengthen the construction of civil mediation organizations,give play to the role of judicial experts,perfect the targeted laws and regulations,and strengthen the publicity and ed⁃ucation of laws and regulations.
