摘　　要：由《专利法》第四十九条解读而分析专利强制许可在公共卫生危机中的经济价值和人权价值,进而探讨了在公共卫生危机中对医疗防护用品专利实施强制许可的合理性,并建立合理确定强制许可期限、健全专利强制许可审查机制和建立专利强制许可使用费机制。Based on the the interpretation of article 49 in The Patent Law,this paper analyzes the economic val⁃ue and human rights value of patent compulsory licensing in public health crisis,discusses the rationality of compul⁃sory licensing of medical protective equipment patent in public health crisis,and suggests setting reasonable compul⁃sory license period,improving the mechanism of the patent compulsory licensing examination and establishing a mechanism for the patent compulsory licensing fee.
